New Supreme Court Nominee “The Mild Mannered Scalia”

President Bush announced the new Supreme Court nominee this morning after a weekend at Camp David. It is Samuel A. Alito, Jr of the 3rd U.S. Circuit Court of Appeals.

There’s a nickname for federal appeals Judge Samuel Alito Jr. that captures two things at once — his particular brand of legal conservatism and a recognition that his credentials are strong enough to put him on any Republican president’s short-list for the U.S. Supreme Court.
Some lawyers call the judge "Scalito."

Roughly translated, the nickname means "Little Scalia," suggesting that Alito, a judge on the 3rd U.S. Circuit Court of Appeals, has modeled himself after Supreme Court Justice Antonin Scalia.

With Alito in President George W. Bush’s sights as a possible high court nominee, the question is whether he can both overcome the nickname and somehow live up to it.

He’s heading up Capitol Hill, where the reception will be both warm and chilly. When those kinds of temps hit each other in the world of weather, you get lots of thunder. The expectation up on the Hill is that something similar will be developing over the next few weeks.

The Democrats are already mapping out their strategy. Several conference calls have already taken place this morning, coordinating surrogate and third-party campaigns against the nomination. "We’re going to filibuster," a Democratic Senate Judiciary aide proclaimed on his ride into the office. "There is no doubt about that. We began talking about it on Friday when rumors first hit that it might be Alito or Luttig."

John points out in an earlier post what has the Democrats so riled up about Alito: their inability to pin him down judicially. The White House loved the abortion rulings, because they highlighted Alito’s judicial fairness. Democrats will try to attack Alito, but they will find him an equal to Roberts in many regards. Look for Arlen Specter to also be generally pleased. He enjoys an intellectual tussle, and that is what the President has given him.

It is sad that the President felt he had to pick a nominee likely to divide America instead of choosing a nominee in the mold of Sandra Day Oâ€™Connor, who would unify us.

This controversial nominee, who would make the Court less diverse and far more conservative, will get very careful scrutiny from the Senate and from the American people.

Okay, Democrats Bring it on!!!! There is nothing better than a good fight in Committee and on the Senate Floor!

Finally a nominee that Conservatives can unite behind. President Bush’s Poll numbers will increase after this nomination. The Democrats are apoplectic over Alito’s nomination and that is a good thing.
