Polk County Florida & ACLU Reach Agreement

Polk County and the American Civil Liberties Union have reached an agreement over the county’s free speech zone that suspends the need for insurance, a "hold harmless" waiver and a 21-day application period.

The ACLU filed suit in a Tampa federal court last week, alleging the county’s policy for its free speech zone was unconstitutional because it required people to come up with a $500,000 insurance policy to use it.

Federal Court Judge Elizabeth Kovachevich signed off on the settlement Tuesday.

It’s obvious that the ACLU’s scare tactics worked on the Polk County Officials. The $100.00 deposit is about the same price for the liability insurance.

Parties wishing to use the zone near the county administration building still have to abide by rules such as no profanity and a $100 deposit. They also have to apply for a spot.

But the agreement gives both the county and the ACLU a 30day period to reach a permanent agreement or go back to court.

It’s a negotiated, temporary fix," said Polk County Attorney Joseph Jarret.

In the meantime, everyone saves money because the county and ACLU won’t spend the holidays racking up lawyer fees, and the average citizen doesn’t have to come up with a $500,000 insurance policy.
